Hillary Clinton and the School Accountability “Conversation”

When you are a leading candidate for the Presidency of the United States, slight turns of phrase carry more weight than they do for ordinary citizens.  Former Senator and Secretary of State and front runner for the Democratic Party nomination for President Hillary Clinton is no exception.  For example, charter school advocates took multiple turns on the fainting couch when Secretary Clinton made the entirely accurate observation that many of our “high flying” charter schools do not have the same student characteristics as district schools.  For a candidate who has deep and lasting ties to organizations favoring today’s education reform and personal connections to figures like Eli Broad who are advancing plans to rapidly and massively increase charter schools, it was quite an observation which did not go unnoticed by charter advocates – or by supporters of public education.

More recently, Secretary Clinton gave public education advocates pause when, on the campaign trail in Iowa and in the midst of a larger talk about schools, she said,  “Now, I wouldn’t keep any school open that wasn’t doing a better-than-average job. If a school’s not doing a good job, then, you know, that may not be good for the kids.”

Her comment set off a flurry of responses, mostly negative, from numerous sources for several reasons.  First, the question of schools doing “better than average” raised eyebrows as determining average performance means adding all schools’ together and then dividing the by the number of schools — in the case of K-12 public education, that’s well over 98,000 schools, a substantial portion of which would have to be “below average” because that’s how math works. Some have posed that her comment meant half of all schools would be open to being closed, but that would only be fully true if the target was “median.” Further, no matter how well schools do, there will, by definition, always be those who are “below average.”  Conceptually, it is entirely possible for every school in the country to be doing exceptionally well for all children, and there were still be schools that are below the average.

Also of concern is the implication that schools should be closed, which is one of the central tools of today’s education reform that seeks to label, pressure, and ultimately close schools using standardized test based metrics.  Secretary Clinton almost casually mentioned one of the core aspects of education reform as practiced in the United States,  indicative of how normalized the concept is even with the growing understanding that market disruption in education ends up hurting the children it claims to help, especially black and Latino children who bear the brunt of school closure as policy.  While the federal government has only a peripheral role in policy choices like this, it has played a significant role in encouraging, incentivizing, and funding the expansion of charter schools which can establish themselves in closed schools.  Secretary Clinton’s remarks carried the specter of this continuing during a Clinton administration.

So it is hardly surprising that her campaign was treated to swift and pointed remarks:

First, the good news:  The context of Secretary Clinton’s remarks were in a talk about supporting public schools in Iowa, specifically schools widely regarded as doing a good job but in danger because of Iowa’s particular budgeting laws.  Senior Spokesperson Jesse Ferguson explained that Secretary Clinton was speaking against Iowa’s Governor starving rural school districts with shrinking tax bases and that her career was “a commitment to fixing struggling schools, not shutting them down.”  It is undeniable that her short comment about “below average” schools came in the context of remarks that were broadly supportive of public schools struggling in the face of policies that unfairly deny them necessary resources:

And so for the life of me, I don’t understand why your state government — and I know Governor Brandstad vetoed the money that would’ve come to help this school, and it was a bipartisan agreement. Y’know those are hard to come by these days. You had a bipartisan agreement in your legislature for more one-time student funding to help deal with some of the financial challenges that districts like this one have.

And Governor Brandstad vetoed it. Yet at the same time you have these laws which require if you have a deficit you may not be able to be a school district. It doesn’t make sense to me. When you- When you- Something is not broke, don’t break it. Right?

And this school district and these schools throughout Iowa are doing a better-than-average job. Now, I wouldn’t keep any school open that wasn’t doing a better-than-average job.  If a school’s not doing a good job, then, y’know, that may not be good for the kids. But when you have a district that is doing a good job, it seems kinda counterproductive to impose financial burdens on it.

The full talk is longer than an hour if even more context is needed:

For the sake of argument, I can also accept that “below average” was meant as a clumsy proxy for “not good.”  That’s an acceptable colloquial use, and I do not personally believe that Secretary Clinton would mean below the mathematical definition of average; she’s far too intelligent to not know what it means.  Secretary Clinton absolutely did not mean that we should seek to close nearly half the schools in the country, as was almost gleefully reported in a variety of right wing media outlets (who in their normal daily business, it should be noted for irony’s sake, are all too happy to bash public schools full of unionized teachers).

Of course, there is also bad news.  Peter Greene of Curmudgucation very astutely observed that the context does not exactly absolve Secretary Clinton:

Clinton used “below average” as shorthand for low-performing, which indicates a lack of understanding of exactly how schools end up tagged low-performing, and how the stack ranking of schools is pernicious, inaccurate, and guaranteed to always result in schools labeled low-performing (and for that matter, what “below average” really means). The use of false, inaccurate and just-plain-crappy measures to label schools and teachers as successes or failures is central to what’s going on in education reform. If she doesn’t understand that, she doesn’t understand some of the most fundamental problems we’re facing.

Clinton’s glib use of “wouldn’t keep any school open” shows a limited understanding of just what is involved in “closing” a school. What happens to staff? What happens to students? What happens to the community? Clinton shows no awareness of how huge a task she’s glibly suggesting, nor does she suggest that there are other options that should be considered long before this nuclear option, which should be at the bottom of the list.

This is essentially correct in my opinion, and, as mentioned above, it indicates just how normalized the current language of accountability and threats to schools is without our political landscape.  Schools are measured as successes and failures using distant measurements that are absent any locally understood input, and then they are threatened until those measures rise – or the school is closed and frequently turned over to a private operator with absolutely no accountability to local democratic institutions.  Secretary Clinton may have been, to her credit, talking about the insanity of a state government financially starving local schools, but she signaled that the essential framework of No Child Left Behind is still alive and well in our political discourse.  Given that the new Every Student Succeeds Acts simultaneously maintains annual testing and leaves significant aspects of using that data in school accountability to the states, the tone from Washington will still matter for how the states pursue the law’s requirements.

This reflects a lasting concern among scholars and advocates for public education that in the 32 years since A Nation At Risk was published and in the almost 15 years since No Child Left Behind was enacted, the call for accountability in our education system has been entirely unidirectional – with schools and teachers called upon to lift students and communities from poverty and inequality while the rest of society is called upon to do exactly nothing.  David Berliner wrote about this issue a decade ago as NCLB was coming into full force:

All I am saying in this essay is that I am tired of acting like the schools, all alone, can do what is needed to help more people achieve higher levels of academic performance in our society. As Jean Anyon (1997, p. 168) put it “Attempting to fix inner city schools without fixing the city in which they are embedded is like trying to clean the air on one side of a screen door.”

To clean the air on both sides of the screen door we need to begin thinking about building a two-way system of accountability for contemporary America. The obligation that we educators have accepted to be accountable to our communities must become reciprocal. Our communities must also be accountable to those of us who work in the schools, and they can do this by creating social conditions for our nation that allow us to do our jobs well. Accountability is a two way process, it requires a principal and an agent. For too long schools have thought of themselves only as agents who must meet the demands of the principal, often the local community, state, or federal government. It is time for principals (and other school leaders) to become principals. That is, school people need to see communities as agents as well as principals and hold communities to standards that insure all our children are accorded the opportunities necessary for growing well.

It does take a whole village to raise a child, and we actually know a little bit about how to do that. What we seem not to know how to do in modern America is to raise the village, to promote communal values that insure that all our children will prosper. We need to face the fact that our whole society needs to be held as accountable for providing healthy children ready to learn, as our schools are for delivering quality instruction. One-way accountability, where we are always blaming the schools for the faults that we find, is neither just, nor likely to solve the problems we want to address.

The severity of this problem in many of our communities cannot be overstated.  Consider Whitney Elementary School in Las Vegas, Nevada.  According to the Nevada DOE, Whitney is a “two star” school out of a possible five stars with only 40 points out of 100 on the state’s accountability scale in the academic year ending in 2012.  Data for subgroups, such as children qualifying for free and reduced price lunch, children with disabilities, and children who are learning English, show lower performance at Whitney than for similar children statewide, and Whitney’s overall test based performance and growth measured by tests is much lower than state averages.

Using these external measures we would have to concede that Whitney Elementary is “below average” for academics both in the mathematical sense and in the colloquial sense.  Is that the bottom line, however?  Is this a school that, in Secretary Clinton’s words, “may not be good for the kids”?

I ask because I learned about this school via a story on Public Radio International’s The Takeaway, where co-host Celeste Headlee investigated the trying circumstances of America’s working poor and homeless families in the run up to the 2012 election.  Her reporting took her to Las Vegas to a family whose children attend Whitney.  I recommend reading this transcript with a box of tissues nearby:

Headlee: Rick’s kids go to the Whitney School where half of the kids are homeless.  At the Whitney, the school provides meals not just for the school day but for the weekend as well.  Kim Butterfield is a teaching assistant at Whitney.  She says her students are clearly hungry and desperate.

Butterfield: I work in the cafeteria for lunch duty, and a lot of times I would see children putting ketchup packets in their pockets, lots of them, to take home for – what they do is put a little water in them to make ketchup soup.  And just noticing the kids were very hungry, all the time.

Headlee: Without those free school meals many of these kids would not have anything to eat.  Instead of talking about TV shows or music or Facebook, these kids talk about food and how it feels to be hungry.

Child: We don’t have any dinner at home. It’s already happened five times.

Headlee: How does that feel?

Child: Well, it felt kind of weird because it felt like I was kind of getting dizzy one time.

Headlee: And like Rick’s kids, the rest of the students at the Whitney also worry about their families. Eight year old Steven says he tries hard in class, but he can’t stop thinking about his pregnant mother.

Steven:  We don’t have enough money to get the food for the baby. I feel really sad for it, so that’s why mother thinks we’re going to give it to adoption.  But I’m not sure if it costs money and the good thing about it is my mother gets to choose who it is.

Headlee: Another student, Leslie, is six but without the bubbling energy we often associate with first graders. In hushed tones, Leslie describes  what appeared on her dinner table one night.

Leslie (whispering): My mom ate rats.

Headlee: Eating rats? Is that something that happens – a lot or it happened just once?

Leslie: Once.

Headlee: Once.  Was that because she ran out of food?  Yeah. How did that make you feel?

Leslie: Sad.

 

Sherrie Gahn, Principal at Whitney, explained what occupies her students’ minds that distracts from their academics:  “The dream here is that these children will be on the same level playing field as any other child in America. We know that doesn’t happen because they are in such survival mode and they can’t possibly learn because they are not thinking about learning. They are thinking about their shoes hurting or where they are going to go to sleep at night or if they are going to have a place to sleep at night or their tummies are grumbling.”

Let’s be frank:  Whitney is obviously an extreme example of the kinds of schools where students come from struggling families and communities.  However, because of our outsized child poverty rate where 45% of children live in families that are either in or near poverty and because of our high rates of income segregation, there are a staggering number of schools classified as “high poverty” by the federal government, meaning that more than 75% of students are eligible for the free and reduced price lunch program.  In the 2007-2008 school year, there were 16,122 such public elementary and secondary schools in America, 18% of all public K-12 public schools.  While the children at Whitney are in exceptionally dire straights, there many thousands of schools whose students’ families are only a few paychecks from joining them.

With that in mind, I dare anyone to look at a school that is literally all that is standing between its children and daily hunger and call it a failure – or even “below average”.  Go on.  Try.

Berliner’s concept of “two-way accountability” is absolutely essential here.  The teachers and administrators at most of our most poverty stricken schools want what is best for their children.  But for decades, they have labored in a policy environment that demands that they lift those children from poverty while the rest of society accepts zero responsibility for the policies that have ravaged their communities.  Our child poverty rate is not natural law.  In many ways it is a choice that could be addressed by policy as other nations have done.

If Secretary Clinton wants to talk about education in terms that evoke accountability, I challenge her to only do so when similarly challenging our society and our economy to be equally accountable for opportunity and for providing the resources needed for equitable opportunity to become our norm.  I challenge her to talk about fully funding the Individuals with Disabilities in Education Act.  I challenge her to talk about the estimated $197 billion in capital improvements needed in our school facilities just to get all schools to “good” condition.  I challenge her to call for full wrap around services in all “high poverty” schools and to increase Title I funding available to schools serving poor children in general.  In short, I challenge her to change the conversation on accountability to one reflected in the title of her 1996 book, It Takes a Village.

She was right on that.  She should take up that challenge now.

#TeachStrong? Brother, Here We Go Again…

Education reformers in the 21st Century seem incapable of seeing any problem as something other than a marketing campaign.  Faced with growing grassroots opposition to the Common Core State Standards, the Thomas B. Fordham Institute, backed with fresh cash from the Gates Foundation, launched a #SupportTheCore event on social media to try to make CCSS support look genuine and natural.  As they felt control of the education reform narrative slipping from their grip, major corporate backers of standardized testing and school privatization handed $12 million to former Arne Duncan aide Peter Cunningham to launch The Education Post, a pro-reform blogging outpost, providing content for itself and editorial pages.  Needing to dress up her campaign to destroy the collective bargaining and due process rights of our nation’s teachers as something more noble, former news anchor Campbell Brown set up her own web headquarters called The 74, referencing the estimated 74 million children under the age of 18 Brown claims she is defending from greedy unions.  It seems that whenever they want to tackle difficult and contentious issues, reform advocates turn immediately to the tools of viral advertising and public relations to create the imagery of genuine, natural support rather than bothering with the hard work of building it.

Cue #TeachStrong.

Let’s agree to set aside the choice of a name that inevitably invokes one of the worst doping scandals in the history of sport (although, seriously?  millions of dollars in expert branding experience and nobody thought about that??).  “Teach Strong” is the name chosen by a new group of stakeholders organized by the Center for American Progress to make teachers and the future of teaching an issue in the upcoming election.  The campaign launched this week with a splashy web site and social media campaign, which is is par for the course these days, and a declaration of 9 “principles” that they believe will “modernize and elevate” the teaching profession.

Lyndsey Layton mentioned in The Washington Post that the coalition includes “some strange bedfellows,” and she certainly was not kidding.  On one side, Teach Strong has both major national teacher unions, the NEA and the AFT.  It also has the American Association of Colleges of Teacher Education, the national association of college based teacher preparation programs, and it has the Association for Supervision and Curriculum Development, a long standing national organization for public school leaders.  Also in the coalition is the National Board for Professional Teaching Standards, which grew out of the Carnegie Forum on Education and the Economy’s response to A Nation At Risk and the National Commission on Teaching and America’s Future, whose early work was heavily influenced by executive director Linda Darling- Hammond, indisputably one of the leading experts in teacher preparation. Teach Strong is also joined by the National Center for Learning Disabilities, a long time education advocate for disabled children and by The New Teacher Center, a non-profit that grew out of the nationally recognized teacher mentoring and support program at University of California, Santa Cruz and which now assists states and school districts across the country in developing new teacher induction and mentoring.

On the other side?  There is the omnipresent Teach for America which recruits high achieving college students, gives them less than two months of preparation, and then places them in some of our nation’s highest need school districts for two years.  They are joined by “Educators 4 Exellence,” a foundation funded astroturf group dedicated to promoting the Common Core State Standards and hosting a pledge that has members standing up for assessing teachers using standardized test scores.  The similarly foundation backed “Deans for Impact” joins the table as an extremely small group of education school deans committed to various aspects of current reform efforts, and Relay “Graduate School” of Education is also present, bringing their odd posture as a graduate school that produces no research and which basically uses no excuses charter school teachers to certify other no excuses charter school teachers mainly using online modules.  Former Arne Duncan aide Peter Cunningham’s Education Post is present, which is bizarre given its status as primarily a content delivery forum for education reform advocates.  Revoltingly, the National Council on Teacher Quality is also on board – NCTQ is a self appointed watchdog of teacher “quality” which has such a rigorous system for reviewing teacher preparation programs that it basically sits in its offices in Washington reading online course catalogs before informing the nation that our teacher preparation programs are all horrible.

I suppose representatives from the Center for American Progress, an organization that has long been on the reform side of the Common Core and standardized testing debate, would call this a “Team of Rivals” to match the famed Lincoln Cabinet.  I guess that’s one way of looking at it.  Another way of looking at it would be if the Academy of Nutrition and Dietetics partnered with the Hormel corporation to design a school lunch program – you hope the more knowledgeable partner is guiding the work, but you strongly suspect that a lot of snouts and tails are going to get in there too.

What will TeachStrong aim this odd set of partners at?  Nine principles are given top billing:

Peter Greene of Curmudgucation rightly notes that many of these principles are laudable – depending upon what actually materializes from them.  Given the perspectives and previous projects of many of the partners in this effort, including TFA which stated in The Washington Post article that it felt no need to change its own five week training program to meet the principles outlined above, it is right to be cautious about what will materialize here.  If “Reimagining teacher preparation to make it more rooted in classroom practice” means helping to bring more university-school district professional development schools to scale so that prospective teachers can constantly learn from practice while universities and schools inform each others’ work, that would be wonderful.  If it means setting up more outfits like Relay “Graduate” School of Education where people with no teacher preparation get competency based modules on no excuses charter school practices, no thank you.  If “Provide significantly more time, tools, and support for teachers to succeed” means giving teachers genuine collaborative control of their professional development and having administrators facilitate teachers getting what they determine they need, fantastic.  If it just means more “granular” standardized testing data and a few more resources to jump through SLO hoops, that’s a big meh.  If “create career pathways” means acknowledging excellent teaches and finding roles for teachers to play in induction and mentoring, curriculum development, and setting school and district policy, let’s talk.  If it just means finding teachers with high value added measures on tests and giving them bonus cash, forget it.

While the devil remains in the details, a bit of that devil also resides in some very obvious retreads of past efforts to reform teaching.  In fact, efforts to “modernize and elevate” teaching go back to the founding of many of our comprehensive public universities that began as normal schools before morphing into teacher colleges and then to regional universities.  At every step of this evolution, there was an odd relationship whereby the field of education was held in disrepute even though the emerging comprehensive universities relied upon the teacher preparation mission of education schools.  While the model of teacher preparation within a university setting was well established by the middle of the 20th century, this lack of status for the work persisted, and, following the release of A Nation at Risk in 1983, a flurry of activity was aimed at enhancing and improving teacher preparation.  In fairly short order, reports from the Carnegie Forum on Education and the Economy and The Holmes Group produced proposals on how to improve teacher preparation and make it more in line with professional preparation in high status professions.  Clinical language and portrayals of teaching as at least a partially technical practice subject to data driven analysis became more common.  John Goodlad weighed in with Teachers for our Nation’s Schools that included 19 “postulates” outlining the professional territory and responsibilities of teacher preparation.  The National Commission for Teaching and America’s Future also provided a summary report called What Matters Most: Teaching for America’s Future which further detailed a professional vision of teacher preparation aimed at replicating crucial elements of high status professions.

So let’s just stipulate that this is hardly a revolutionary concept, okay?

What might be ground breaking is the standard imprint of 21st century education reform – slick marketing, an emphasis on jamming things through quickly without thinking about consequences, and generally treating problems as public relations issues instead of as structural concerns.  I am apprehensive that this is precisely where this is heading in no small part because, like so much else we contend with today, the campaign appears rooted in the notion that everything we are doing in school is obsolete and must drastically modernize immediately or we are all doomed.  This is painfully wrong, and anyone who thinks that teacher preparation has remained unchanged in the past 30 years (Yes, that’s you NCTQ) needs to retreat to a library and not come back for at least two semesters.  While I will never say that teacher preparation is unable to improve, it is also true that anyone who has gotten a teaching certificate since the 1980s has likely seen significant changes, often positive changes, as a result of efforts previously mentioned.  From increased time spent in classrooms prior to student teaching, to stronger pedagogical and content preparation, to vastly improved preparation for working with students with disabilities, teacher preparation has not been standing still, and it would behoove a number of the Teach Strong partners (Again, that’s you, NCTQ) to familiarize themselves with the kinds of evidence that the 656 teacher preparation programs accredited by the National Council for the Accreditation of Teacher Education (since merged with TEAC and changed to the Council for the Accreditation of Educator Preparation) have had to provide in order to demonstrate their strengths.

The reality is that our teacher workforce, whether made up of recent graduates from traditional programs who have benefited from changing preparation in the last 3 decades or whether made up of experienced veterans who have been continuously improving their practice over time, is not a static and obsolete lump that threatens our future as portrayed in the Teach Strong launch rhetoric. How we prepare and license teachers grew and developed over a 100 year long period, and there have been significant efforts to develop that process over the past three decades that have actually impacted change.  If Teach Strong can work thoughtfully to help increase the scope of the most beneficial of those practices, it will be a positive influence, but if it simply tries to rush in the shallow metrics of NCTQ and the fly by the seat of your pants preparation of TFA and Relay, well, you get the picture.

There is, however, another, deeper, problem in all of this.  While the teacher professionalization efforts of the 1980s and 1990s had some positive impacts, they had one seriously negative effect, an effect that has been compounded since test-based accountability took control of education policy.  By emphasizing the type of preparation practices in high status professions, teacher professionalization tended to emphasize teaching as a technical and rational act with special emphasis on those aspects of teaching that can be measured or demonstrated.  While this has some merit, over emphasizing it has diminished a critical aspect of teaching: vocationalism.  David Hansen wrote cogently on this concern:

To describe the inclination to teach as a budding vocation also calls attention to the person’s sense of agency.  It implies that he or she knows something about him or herself, something important, valuable, worth acting upon.  One may have been drawn to teaching because of one’s own teachers or as a result of other outside influences. Still, the fact remains that now one has taken an interest oneself.  The idea of teaching “occupies” the person’s thoughts and imagination.  Again, this suggests that one conceives of teaching as more than a job, as more than a way to earn an income, although this consideration is obviously relevant.  Rather, one believes teaching to be potentially meaningful, as a the way to instantiate one’s desire to contribute to and engage with the world.

If Teach Strong is serious about a pipeline of great potential teachers, it had better look harder than most recent reform efforts that constantly emphasize getting the best students into teacher preparation without being concerned whether or not they are driven by the best motivations.  It also means that rather than focusing on impossible goals like elevating the salaries of 3 million teachers to the salaries of doctors and lawyers, it would be much better to focus upon working conditions that grant teachers significantly more autonomy and input into how their work and workplaces are conducted.  People driven by vocational aspirations may be willing to forgo some compensation – but they cannot forgo having a say in what they do.

This is the kind of teacher we should all be working to see with all of our children:

Eva Moskowitz and the Terrible, Horrible, No Good, Very Bad Month

Eva Moskowitz, founder and CEO of the Success Academy charter school network in New York City, is used to getting her way.

Since founding her first school in 2006, her network has grown to 34 schools with 11,000 students, and she is on track for 43 schools by next year with a goal of 100 eventually.  Her school lotteries were portrayed as the only hope of desperate parents in Waiting for Superman, a 2010 documentary/propaganda piece by David Guggenheim, and email records demonstrate that the administration of Mayor Michael Bloomberg lavished her with preferential treatment.  When both the state legislature and the office of Comptroller tried to exert legal authority to audit how Success Academy spends the public money it receives, Moskowitz has gone to court to block them – and won.  Her deep pocketed backers can raise millions of dollars on her behalf in a single night, and their donations to New York Governor Andrew Cuomo, along with donations from Moskowitz’s own political action committee, have guaranteed preferential treatment from the Governor’s office.

This treatment had tangible results early in the administration of Mayor Bill DeBlasio when Governor Cuomo rode to Moskowitz’s “rescue” after the new administration put a stop to 3 of 17 hastily approved Success Academy co-locations – one of which would have displaced severely disabled students from their school and into district schools far less able to serve them properly.  Moskowitz ran to the press, declaring that the new mayor had “declared war” on her and the entire charter sector, and a multi-million dollar ad campaign materialized practically overnight.  Moskowitz closed all of her schools to take parents and students to Albany for a rally on the same day that Mayor DeBlasio was in the state capitol rallying for universal pre-Kindergarten, and Governor Cuomo appeared at her side vowing to “save” charter schools.  It was later revealed that Governor Cuomo not only attended the Moskowitz rally, but also he essentially helped orchestrate from his office.  Later that Spring, Governor Cuomo delivered a budget package that required New York City to either house charter schools in public school buildings or to pay for their private space and that forbids charging such schools rent.  Recall that Moskowitz has fought tooth and nail to prevent anyone from knowing how she spends the public funds she collects.

Moskowitz has grown used to adulation in the media as well.  Jonathan Chait believes that Moskowitz is a “hero of social justice” and declared her schools “a staggering triumph of social mobility” – an odd claim for a school network that has not graduated a single high school student yet.  Chait chalks up opposition to Moskowitz solely to unions grousing that her non-unionized faculty have such staggeringly high test scores.  The New York Times’ Daniel Bergner authored a piece for the weekly magazine that was an astonishing exercise in hagiography, plainly ignoring almost any input he got that was not laudatory.  Interestingly enough, Mr. Bergner pretty much signaled his intention to write such an imbalanced piece in the comments section of this WNYC story — almost 6 months before his article in the Times was published:

There’s something bizarre about the way the charter school story tends to be reported by the New York media….Success, the charter organization that’s been most vilified by Mayor DeBlasio, has a stunning record of academic achievement. It’s a record that puts many traditional public schools to shame. This should come at the top of any story like this one by WNYC….Money matters, yes. But the biggest question is how a school run by Success in Harlem, a school that teaches mostly underprivileged kids, has managed to out-perform every single public school in the state on math exams. Let’s look closely at that. We all might learn something infinitely valuable.

In July of this year, billionaire hedge fund manager John Paulson, gave a single $8.5 million gift to the network for creating even more schools. My goodness, but it is good to be Queen.

But things have unraveled a bit for Moskowitz.  First, The New York Times ran a fairly comprehensive story in April covering the network’s record of very high standardized test scores and its similar record of extreme practices, including public shaming of students with low scores and practice test environments so high pressure that young children wet themselves. Moskowitz immediately wrote an email to her network’s employees to complain that the article, which included both positives and negatives, was “slanted” and that the Times was “out to get us.”  Moskowitz erroneously claimed that the article was the “first time” that the Times had given Success Academy “even moderate praise” — apparently forgetting the Sunday magazine feature by Daniel Bergner less than a year previously.  In her email, she continued her long standing habit of telling her employees and families that the outside world is out to get them: “We are disrupters, we are changing the status quo, and that threatens a system that has existed more or less unchanged for decades.”

The new school year began in a manner to which we have grown accustomed: Moskowitz’s political allies in the billionaire funded astroturf organization, “Families” for Excellent Schools, running hit ads on Mayor DeBlasio. The ads were racially charged, accusing the mayor of leaving over half a million students in “failing schools” (up from last year’s accusations of 140,000 students suffering that fate), and the ads drew immediate and harsh criticism.  Moskowitz used two scheduled half days of classes to provide students, families, and teachers as window dressing for different “Families” for Excellent Schools sponsored rallies, an action that would likely get any public school superintendent swiftly fired.  Moskowitz also teased the media early in October with a planned big announcement on the 7th, which turned out to be her stating that she would not seek the mayor’s office in 2017 as many of her supporters had anticipated.  Instead, she declared she would continue to focus on education where she compared the work of her network to the development of the iPhone.

Things went south rather quickly from there.

On October 12th, PBS Newshour aired a story by retiring veteran education reporter, John Merrow, detailing the use of repeated suspensions on children as young as 5 years old within the Success Academy network and accusations that Moskowitz uses her 65 infraction long discipline policy to repeatedly suspend students she does not wish to educate until parents withdraw them from school:

The piece, which includes lengthy segments of Moskowitz looking uncomfortable while claiming her schools don’t suspend students for many of the very minor infractions that are listed as suspension worthy (Mr. Merrow includes the entire disciplinary code, verbatim, on his personal blog), also included material from a mother and son who were willing to talk on camera about some of the incidents that led to his repeated suspensions from a Success Academy.  While those incidents were quite minor, his mother also speaks about her son having outbursts, allowing a reasonable viewer can infer that his full range of behavior was broader than discussed on camera, and the mother says her son was suspended in first grade for losing his temper.  The mother and son take up a grand total of one minute and 12 seconds in the over nine minute long story.  Although the story says their names, I am not going to do so for reasons that should be evident next.

Eva Moskowitz was not happy.

In a lengthy and accusatory letter to PBS that she posted to Success Academy’s website (and to which I refuse to link), she demanded an apology from PBS, disputed Mr. Merrow’s factual findings, and was especially incensed about the inclusion of material from the mother and son who were willing to go on camera.  She released a series of a email communications where she claimed Mr. Merrow misled her (although to my reading they also seem to indicate that she wanted practical editorial control over the story), and then she did something that any ethical educator should find completely unthinkable: she detailed specific incidents from the young man’s disciplinary record, including verbatim text of email communications from teachers about particular events.  PBS Newshour responded with a clarification that acknowledges the story should have allowed Moskowitz an opportunity to respond on camera to the allegations but that also defended the accuracy of Mr. Merrow’s piece overall.

The reason that I refuse to link to the Success Academy letter or to name the mother and son in this piece is because of a federal law that should have limited Moskowitz’s response to the Newshour segment.  The Federal Education Rights and Privacy Act (FERPA) forbids schools and school officials from releasing education records to anyone without prior approval from a parent or a student (if that student is over 18).  While I am not bound by FERPA in this matter, as a matter of ethics, I find it appalling that Moskowitz would respond to the situation by publicly releasing information on a child, now ten years old. While the mother and son did go on camera to discuss some of his disciplinary problems at Success Academy, they did not approve of the release of his full disciplinary record and FERPA is written in such a way that such express permission must be granted.  Even if one is inclined to think that Merrow did not play fair in his story, the only fully legal response from Moskowitz, and the only one Mr. Merrow could have aired, would be: “We cannot discuss his whole record without permission, but suffice to say, there was more going on than his mother said.”  It is also the only moral response, but Moskowitz has always had a scorched earth approach when it comes to her reputation.

Moskowitz was sent a cease and desist letter demanding the letter be taken down from the school web site and disputing a number of facts as portrayed in it.  In response, Success Academy put another letter on its website, claiming a “First Amendment” right to respond as they did, saying: “Success Academy had a constitutional right to speak publicly to set the record straight about the reasons that your son received suspensions.”  This interpretation is false as FERPA does not prevent them from responding, but it absolutely limits the legal content of that response.  As of October 30th, the Federal Department of Education has been sent a formal request to intervene in the case on the grounds of Moskowitz’s violation of FERPA and refusal to remedy the situation.

Moskowitz’s bad month was not over, believe it or not.

On October 29th, The New York Times ran a blockbuster story that the principal of Success Academy in Fort Greene, Brooklyn, Candido Brown, kept a list of 16 students entitled “Got to Go,” meaning they were students he wanted to leave the school due to their difficulties in adjusting to the strict disciplinary policies.  Kate Taylor’s story confirms that the mother of one student on the list was actually told that Mr. Brown would have to call 911 if her daughter, who was six years old at the time, continued to defy rules.  Nine students on the list withdrew from the Fort Greene Success Academy, parents reported their lives disrupted by constant calls to pick up their children early, and four of the parents told the Times they were directly told they should seek another school.  While the “got to go” list may have been restricted to Principal Brown’s school, other sources reported similar behavior at other schools in the network.  One principal told employees not to automatically send re-enrollment paperwork to certain families, and another source described a network attorney describing the withdrawal of a particular student “a big win” for the school.  Other sources described network staff and leaders “explicitly talked about suspending students or calling parents into frequent meetings as ways to force parents to fall in line or prompt them to withdraw their children.”

Moskowitz quickly threw together a press conference on October 30th with many of her network’s principals standing behind her and denied that Principal Brown was following Success Academy policy.  She affirmed her support for the tough disciplinary practices of her schools but insisted they were about having high standards and denied any intention to use them to drive away undesired students.  In an interesting twist, Moskowitz declared that, despite advice from others, she would not fire Principal Brown, asserting “at Success we simply don’t believe in throwing people on the trash heap for the sake of public relations.” (That fate after all, is reserved for Kindergarten children)  Principal Brown then took the podium in tears and took full responsibility for the “got to go” list, saying “I was not advised by my organization to put children on the list. I was not advised by my organization to push children out of my school.”  Moskowitz, true to form, sent an email to staffers on the 30th where she, again, accused the media of having “conspiracy theories” about Success Academy – because when faced with the slow unraveling of your organizational mythology, the best thing to do is harp about how outsiders are out to get you.

It is, honestly, puzzling that Success Academy would continue to go through this charade trying to convince people that they do not force students out as policy – given that in 2010, they pretty much admitted it in the open in a lengthy portrait of the growing network in New York Magazine.  Consider this from the last section of the article:

At Harlem Success, disability is a dirty word. “I’m not a big believer in special ed,” Fucaloro says. For many children who arrive with individualized education programs, or IEPs, he goes on, the real issues are “maturity and undoing what the parents allow the kids to do in the house—usually mama—and I reverse that right away.” When remediation falls short, according to sources in and around the network, families are counseled out. “Eva told us that the school is not a social-service agency,” says the Harlem Success teacher. “That was an actual quote.”

…. “They don’t provide the counseling these kids need.” If students are deemed bad “fits” and their parents refuse to move them, the staffer says, the administration “makes it a nightmare” with repeated suspensions and midday summonses. After a 5-year-old was suspended for two days for allegedly running out of the building, the child’s mother says the school began calling her every day “saying he’s doing this, he’s doing that. Maybe they’re just trying to get rid of me and my child, but I’m not going to give them that satisfaction.”At her school alone, the Harlem Success teacher says, at least half a dozen lower-grade children who were eligible for IEPs have been withdrawn this school year. If this account were to reflect a pattern, Moskowitz’s network would be effectively winnowing students before third grade, the year state testing begins. “The easiest and fastest way to improve your test scores,” observes a DoE principal in Brooklyn, “is to get higher-performing students into your school.” And to get the lower-performing students out.

So we’ve known this since at least 2010.  Eva Moskowitz does not believe in serving children with special needs as required by federal law, and the network openly scoffs at individualized education plans, blaming them on bad parenting.  Her schools don’t provide needed resources and counseling, favoring repeated suspensions and harassing parents until they leave.  Moskowitz, referencing special needs children, directly told teachers that the school is “not a social service agency.”

But we’re supposed to believe Principal Brown came up with his “got to go” list all on his own.

And just to make the month complete: Moskowitz is heading for another legal showdown.  This time, it is over her insistence that the city of New York give her money allocated for pre-Kindergarten providers but not require her to sign the city contract that every other provider, including other charter schools, has signed.  Success Academy already has 72 pre-K students, and the network would be eligible for $10,000 per student in funding, but city Comptroller Scott Stringer declared that Moskowitz cannot decline the contract that every one of the other 277 approved pre-K providers has already signed.  This is true to form for Moskowitz who has won other legal fights to prevent any state or city authority from oversight over how she spends the public money she receives.  Given how other charter providers have already signed the same contract, some grudgingly, this fight seems more geared towards maintaining her special status as the charter network entirely above public accountability of any sort than over much else.

I suspect that Moskowitz will bounce back from this month.  After all, she still has Governor Cuomo in her hip pocket (although he isn’t winning many popularity contests himself).  More importantly, she still has her billionaire backed political machine designed to bend public opinion and politicians to her cause, and there is no indication that they are going anywhere.  She is still the driving force behind the largest charter network in the city, and her goal of 100 schools is still probably attainable.  However, in a very real way, I suspect one thing is changing permanently.

Moskowitz is losing total control of her situation.

Success Academy is run in a very particular way.  It has a dynamic, forceful, and very visible personality at the top of the organization.  The policies, tone, and demeanor of the organization flow entirely from that person who exerts an extraordinary level of control of the operation right down to the classroom.  There is a very narrow band of acceptable behaviors and attitudes.  Teachers who embody those behaviors and attitudes can rise very quickly with some becoming school principals in their mid-20s, and students who do similarly well are rewarded with toys and other goodies. Those who do not thrive are subjected to rigorous and frequent “corrections” that either mold them into proper form or convince them to leave. The network has an arguably paranoid attitude towards “outsiders,” frequently declaring to themselves that figures in the press and public are out to get them because they have cracked the code and are disruptors of the status quo.  Those who leave and speak out about the network’s inside information are viciously attacked.

But Success Academy has grown far too large to keep the lid on everything now.  Moskowitz enrolls 11,000 students in 34 schools.  She has around 1000 teachers and staff.  With such numbers and given their policies, there will likely be 1000s of former “scholars” and 100s of former teachers in short order, and all of them are not going to be intimidated into silence about what they saw while there.  The simple fact is that Moskowitz absolutely cannot keep total control over what people say and know anymore, and it is her own policies of driving away students she does not want and burning out teachers that has put her in this position.  So even if she fully recovers from this month, I think it is likely we will see many more months like this.

The next couple of years will be interesting.

Lies, Damned Lies, and PARCC Scores

In February of this year, as communities and schools in New Jersey were awaiting the arrival of PARCC testing, I wrote this opinion piece for the Bergen County Record.  In it, I said:

What can be expected? If experiences of other states that have already implemented PARCC- and CCSS-aligned exams are illustrative, New Jersey’s teachers, students and parents can expect steep declines in the percentage of students scoring in the higher levels of achievement. Neighboring New York, for example, has its own Pearson-designed CCSS-aligned exam, and the percentage of students scoring proficient or highly proficient was cut essentially in half to roughly 35 percent for both math and English….

….There is no reason to believe that 11th-graders today are any less skilled than their peers who took the HSPA last year or who took the NAEP in 2013, but there are plenty of reasons to believe that a drop in scores on PARCC will be exploited for political purposes.

It is a terrible burden being proven correct so often.

The New Jersey DOE released its report on the statewide results on PARCC this week, and immediately their meaning was thoroughly misrepresented by the media and by state Commissioner David Hespe. Writing for NJ.com, Adam Clark said that the results mean “The majority of New Jersey students in grades 3 through 11 failed to meet grade-level expectations on controversial math and English tests the state says provide the most accurate measurement of student performance yet.”  In the same article, Commissioner Hespe is cited as saying:

Overall, the results show that high school graduation requirements are not rigorous enough for most students to be successful after graduation, state Education Commissioner David Hespe said. The 2014-15 results set a new baseline for improving student achievement, he said.

“There is still much work to be done in ensuring all of our students are fully prepared for the 21st century demands of college and career,” Hespe said.

Neither claim is remotely based on a factual representation of what these test scores mean.  As my colleague Dr. Chris Tienken noted:

To begin with, the statement that the majority of students “failed to meet grade level expectations” is entirely dependent upon the “meets expectations” and “exceeds expectations” being a proper representation of “grade level” work for each year tested.  There is no basis for making this determination.  PARCC has not provided research to bolster that claim, and, more importantly, we know that reading passages in the exam were specifically several grade levels above what can be developmentally expected of different aged readers.  Russ Walsh of Rider University analyzed sample PARCC reading passages that were available in February of this year, and he found that using most agreed upon methods of determining readability that they were inappropriate for use in testing.  There is no justification for such choices in test design unless the test makers want to push the cut scores for meeting and exceeding expectations well above what the median student is even capable of developmentally.  It is therefore entirely unjustifiable to call these examination results proof that our students are not doing their work “at grade level,” and honestly, it is getting damned tiring to have to repeat that endlessly.

Commissioner Hespe’s comments were no more helpful, and certainly were not based in facts.  The Commissioner repeated the often heard claims that the PARCC exams represent a more appropriate set of skills to demonstrate that our students are “ready” for the 21st Century and to measure their “college and career readiness,” but the justifications for those claims have never been subjected to public scrutiny.  While the language of “college and career readiness” is slathered all over the Common Core State Standards and the aligned examinations written by PARCC and SBAC, repeating a slogan is a marketing tool rather than research validation.  Five years after the standards were rammed through into 43 states and the District of Columbia, we are no closer to understanding the validity of the claim that the standards embody “college and career readiness” nor are we closer to knowing that the examinations can sort out who is or is not “ready.”

Further, the Commissioner’s claim that the test results “prove” that New Jersey high school graduation requirements are “not rigorous enough for most students to be successful after graduation” rests on two unproven contentions: 1) that PARCC actually is sorting those who are “ready” for college and careers from those who are not and 2) students who do not score “at expectations” or above can blame any lack of success they have later in life on their primary and secondary education rather than on macroeconomic forces that have systematically hollowed out opportunity.

Let’s consider the first part of that claim.  PARCC claims that its Pearson written exam is a “next generation” assessment that really requires students to think rather than to respond, but does it actually achieve that end?  Julie Campbell of Dobbs Ferry, New York, has had experience with students taking the New York common core aligned examinations which are also written by Pearson, and while she is supportive of the Common Core Standards, she is highly critical of the caliber of “thinking” the exams require:

The four-point extended response question is troubling in and of itself because it instructs students to: explain how Zac Sunderland from “The Young Man and the Sea” demonstrates the ideas described in “How to be a Smart Risk-Taker.”  After reading both passages, one might find it difficult to argue that Zac Sunderland demonstrates the ideas found in “How to be a Smart Risk-Taker” because sailing solo around the world as a teenager is a pretty outrageous risk! But the question does not allow students to evaluate Zac as a risk taker and decide whether he demonstrates the ideas in the risk taker passage. Such a question, in fact, could be a good critical thinking exercise in line with the Common Core standards! Rather students are essentially given a thesis that they must defend: they MUST prove that Zac demonstrates competency in his risk/reward analysis.

So one can hardly be surprised to find an answer like this:

 One idea described in “How to be a Smart Risk-taker” is evaluating risks. It is smart to take a risk only when the potential upside outweighs the potential downside. Zac took the risk because the downside “dying” was outweighed by the upside (adventure, experience, record, and showing that young people can do way more than expected from them). (pg 87)

Do you find this to be a valid claim? Is the downside of “dying” really outweighed by the upside, “adventure”? Is this example indicative of Zac Sunderland being a “Smart Risk Taker”? I think most reasonable people would argue against this notion and surmise that the student has a flawed understanding of risk/reward based on the passage. According to Pearson and New York State, however, this response is exemplary. It gets a 4.

There may not be “one right answer” in an examination like this, but what might be actually worse is that students can be actively coached to submit “plug and play” answers which mimic a style of thinking but which have no depth and, worse, can be nonsensical just so long as they hit the correct rubric markers.

We should also question Commissioner Hespe’s contention that these exams are showing us anything new about our high school graduates and students in general.  They most decidedly are not.  Again, the New York experience is illustrative. Jersey Jazzman does an outstanding job demonstrating that in New York State, even as proficiency levels tumbled off the proverbial cliff, the actual distribution of scale scores on the different exams barely moved at all.  The reason is simple: once raw scores are converted into scale scores on a standardized exam, they, by design, reflect a normal distribution of scores, and it does not matter if the exam is “harder” or not — the distribution of scaled scores will continue to represent a bell curve, and once the previous scores and current scores are represented by a scatter plot, 85% of the new scores are explained by the old scores.  In other words: the “new” and “better” tests were not actually saying anything that was not known by the older tests.  The decision to set proficiency levels so that many fewer students are “meeting expectations” is a choice that is completely unrelated to the distribution of scores on the tests.

So let’s check if we really are concerned that New Jersey students are graduating not “ready for college and careers.”  Here are the statewide scores on PARCC according to the DOE release:

So this means, in the language of PARCC, that “only” 41% of New Jersey 11th graders are “on track” to be “college and career ready” in English, and “only” 36% of Algebra students are similarly situated (Again, remember that score distributions are likely almost entirely unchanged from the previous state assessments – this is about how high the cut scores are set).  Oddly enough, the DOE pretty much admits that we did not need PARCC to demonstrate this to us because New Jersey participates in the National Assessment of Educational Progress testing every several years, and, wouldn’t you know it, NAEP and PARCC results are not perfectly aligned, but they come pretty darned close (as do SAT and ACT scores):

The high school reading and algebra proficiency levels are almost entirely identical comparing PARCC to NAEP.  Dr. Diane Ravitch of New York University sat on the NAEP Board of Governors and has repeatedly explained that both the “advanced” and “proficient” levels in NAEP represent very high level work at the “A” level for secondary students.  So not only have the PARCC scores told us things about our students in NJ that we already knew from NAEP, but also it reaffirms the NAEP findings that over 40% of New Jersey high school seniors are capable of A level work in English and over a third of those students are capable of A level work in Algebra.

If the goal is to have all of our students “college and career ready” by reading and doing algebra at the “meets” and “exceeds expectations” level on a test roughly correlated to NAEP levels indicating A level achievement, then we might as well shut down shop right now because our schools will always fail.  Moreover, we should vigorously question the implication that any student getting respectful if not outstanding grades in core subjects is doomed to failure, and we should certainly question a goal of “college and career readiness” that appears entirely limited to “ready for admission to a 4 year selective college.”  The nonsensical approach of using cut scores to identify the percentage of students likely to seek a 4 year degree and labeling them our only students who are “ready” is based more on a desire to label more schools and students as failures than any other consideration.

The reality is that there are crises relating to education and opportunity both in New Jersey and in the country as a whole.  The first crisis is related to the distribution of opportunity via our education system.  I can walk a few miles from the campus where I teach and find a community where over 70% of the adults over the age of 25 have a college degree, and I can walk a few miles in the exact opposite direction and find a community where that is only 12% of the population.  That is unacceptable and needs to change; it is also something that we knew full well before the PARCC examinations came along, and which we will not address by berating test scores while ignoring the importance of fair and equitable school funding.

The second crisis is in our economy and the simple fact that our economy has shown no signs of actually needing more people with bachelors degrees.  Since 1986, the dollar adjusted wages for people with a BA in the country have grown only by $700, but the college wage premium has grown largely because of the collapse of wages for people without those degrees:

Far from needing many more college graduates, which would push wages even further down, we need an economy where people who work full time without a degree can survive well above subsistence level and closer to their college educated peers as they used to before 1980.  Unless Commissioner Hespe and his fellow PARCC supporters are arguing that college really is the new high school – in which case they had better get to work right away finding a way to make it free for everyone because we cannot possibly survive an economic system that both requires everyone to have a specific degree and requires them to accumulate crushing debt in pursuit of it.

(Just a side observation:  remember when PARCC promised that their “next generation assessments” would “help teachers know where to strengthen their instruction and let parents know how their children are doing”?  It is now about half a year later, and those students have been in their NEW teachers’ classrooms for almost 2 full months now. It is far too late for teachers to even use the score reports to make adjustments in their curricula that they were developing all summer long without the PARCC results. If the goal of the assessments was to give teachers actionable data in anything remotely resembling real time, they are a crashing, embarrassing failure, and given the testing schedule in late Spring, they are likely to remain so.)

Eva Moskowitz is Out of Control

Fresh off their rally with charter school parents and students on October 7th, “Families” For Excellent Schools has announced that they will hold another rally on Wednesday the 21st of October.   This rally, which will be held in Manhattan’s Foley Square, will reportedly feature nearly 1,000 charter school teachers predominantly from Eva Moskowitz’s Success Academy network.  While some teachers from Achievement First, Uncommon Schools, and KIPP are expected to be present, Ms. Moskowitz’s workforce will be the primary participants, and the network just so happens to have a scheduled half school day so that teachers can show up to the rally for the purpose of pressuring law makers into allowing more charter schools in the city.  Chew on that for a moment: a scheduled half day of school.  A political rally.  The teachers in attendance.

I don’t know about you, but when my children’s unionized public school teachers take a half day, it is because they are in professional development workshops and related activities.  They certainly are not being taken from their schools to a rally organized by a lobbying group funded specifically to increase their influence with lawmakers in City Hall and in Albany.  In fact, try to imagine this scenario: Chancellor Farina organizes a half day of work for all city schools and then coordinates a rally for public schools with the UFT on the same day and 1000s of public school teachers, rather than using the half day for professional development, show up near city hall to provide the optics.  If you can pretend for one second that Governor Cuomo would not be demanding that the Assembly and Senate hold hearings and seek potential sanctions against both the union and the Chancellor, I question your grip on reality.

It would be one thing for “Families” For Excellent Schools to organize political rallies for parents and supporters of charter schools to attend and to use that platform to advocate for more such schools.  That is indisputably their right.  It becomes much more questionable when those rallies are organized in such a way that Eva Moskowitz closes her schools during multiple rallies, leaving parents with no place to send their children and essentially forcing them to take a day from work to attend so that they and their children add to event’s optics.  That is within their rights, but frankly, it is cheap and coercive.  But now the network will use a half day of instruction to provide its teachers to send a political message on education policy.  And considering the extraordinarily high pressure work environment at Success Academy that is also verified by job review sites, it is hard to believe that very many of the promised teachers for next week’s rally feel comfortable declining to participate.

And it is monstrously unethical: our fully public schools would spark legitimate outrage if they organized a school day around sending their employees to a political rally organized by a lobbyist organization.  How can it be tolerable for Eva Moskowitz to use her employees, and students, and parents as window dressing for campaigns to funnel more and more public school funding and public school facilities into her organization that she has repeatedly refused to allow “outsiders” to hold her accountable?  What Superintendent of schools has such authority?

It is important to remind ourselves that “Families” for Excellent Schools is a 501 (c) (3) “public charity” that is a front for billionaire backed efforts to radically privatize public education and break public sector unions.  While tax exempt law forbids them from backing specific political campaigns, they are allowed to lobby and to “educate” the public which they do by funneling money from a variety of sources such as the Walton Family Foundation, the Broad Foundation, and Education Reform Now – another dark money financed organization connected with “Democrats” For Education Reform.  “Families” For Excellent Schools suddenly shot up in revenue from June of 2013 when they reported $1,000,777 in revenue to June 2014 when they reported $12,265,162.  Of that, an eye watering $9,137,910 was spent on campaign and advocacy activities, and while their 990 Schedule A cites no portion of their contributions from “individuals” giving more than 2% of total contributions — that means anyone could give $278,103 without it showing up in that part of the form.

This is supposed to be a grassroots organization representing the families of children in charter schools.

And Eva Moskowitz consistently gives them compelling optics at their rallies with children, parents, and, now, teachers – dismissed from school for a “half day” that would get any superintendent in the state fired and possibly prosecuted.

Is Eva Moskowitz running a chain of schools or is she running the lobbying arm for her billionaire backers who see the expansion of the charter school sector as a means for profit and as a means to break public sector unions? Public school advocates certainly hold rallies to support public education, but we have to do so on weekends and after school hours for reasons that should similarly prohibit Success Academy and other charter schools from providing school hour props for “Families” For Excellent Schools.  Our appallingly lax rules for tax exempt organizations may allow for this, but there is no reason why our charter school authorizing bodies and the legislators who write school law should tolerate this.  We need our representatives in Albany to change charter school rules so that orchestrating the participation of students and teachers in obviously political events during what should be school hours is expressly prohibited.

And then maybe we should explore whether or not “Families” for Excellent Schools is actually within the allowable exempt purposes in the Internal Revenue Code, or whether it is there to use children, their families, and their teachers to enact policies that enrich its donors.

Boy, would that be interesting.

“Families” For Excellent Schools Sets a New Bar for Chutzpah

“Families” For Excellent Schools, the hedge-fund and foundation backed advocacy group that has waged constant war on New York Mayor Bill DeBlasio on behalf of the charter school sector in general and Eva Moskowitz’s Success Academy brand in particular, has postponed a planned rally for September 30th due to weather concerns.  Ms. Moskowitz’s 34 schools had planned to cancel classes for the morning to boost attendance for the gathering in Cadman Plaza which was to feature Jennifer Hudson.  Organizers announced the rally will go ahead on October 7th, but it also comes in the wake of a controversial ad buy by FES in which they accuse Mayor DeBlasio of condemning African American children to inferior educations, presumably by merely failing to embrace 100% of what the charter sector in New York City wants and by not allowing Ms. Moskowitz to simply point at an existing school and say “gimme” any longer.

The ad, entitled “A Tale of Two Boys,” can be easily found, and goes like this: Two young boys, one white and one black, are being walked to school, passing each other on the street.  The ad declares that the white child lives in a wealthy neighborhood and has an excellent school and will probably go on to college.  The black child, however, lives in a poor neighborhood, is forced to attend a failing school and will not have a chance to go to college.  The ad ends by contrasting the two young boys with the white child reading happily in school and the black child looking morose and bored, and then it chides the Mayor for allowing this to happen and declaring that “half a million” children “need new schools”.

The ad, which is costing FES 100s of 1000s of dollars, drew immediate criticism from numerous sources for relying upon racial stereotypes and for using the circumstances of minority children to advocate “solutions” that serve the political agenda of conservative organizations (such as the Walton Family Foundation and the Broad Foundation) who have been pushing privatizing education and breaking teachers’ unions for years.  Bertha Lewis of the Black Institute flatly declared the ad racist, and Zakiyah Ansari of the Alliance for Quality Education said, “They are using a black face to push their political agenda, and they make the assumption that all black people are poor…They used our children in a race-baiting commercial.”

Criticism of FES is not limited to the new ad buy.  Writing for The Progressive, New York City teacher, activist, and author Jose Vilson notes about the now postponed rally:

Families for Excellent Schools (an awkward name since everyone wants excellent schools surely), prints “Don’t Steal Possible” on red shirts and hands them out across the city. When a whole host of inequitable conditions, including the stratification of rich and poor, steal possibilities (and lives) from children and adults of color on a daily basis, we won’t see similarly impassioned rallies for their rights. When parents have to take off work for a rally or risk their student getting transferred to a local public school that was stripped of funds for losing students to charter schools, that’s also stealing possible….

What’s most disenchanting about the upcoming rally, though, is that the rally doesn’t serve equal and equitable agency for school-aged children. It ultimately serves the agenda of a handful of people who won’t put their shoes to the cement alongside parents who just want their children to thrive in a good school. If the messaging comes from an unknown busybody and not from the very people affected by the schooling of their children, that’s another swindle our children cannot afford.

Allow me to grant FES a crumb of fact within all of this: educational opportunities are not equally or evenly distributed throughout this city, just as they are not within this country.  Our nation is deeply segregated by income which becomes in many cases a proxy for segregation by race.  A consequence of this is that communities with notable levels of poverty tend to have high levels of poverty, meaning that in order to function well their schools need substantial funding, funding which is denied to them by state and local sources.  Many such schools struggle to provide their students with what they need, leading to lower educational outcomes and diminished opportunities.  However, Jose Vilson rightly points out that many schools with high levels of poverty actually have excellent programs, skilled teachers, and involved PTAs, and they are unfairly deemed “failures” by groups like FES because of one measure only: standardized test scores.  If such schools were also fairly funded and given the resources and capacity to provide all of the services their students need, they could thrive even more.  This is hardly an isolated case.  The portrayal of schools serving mostly minority and mostly impoverished children as nightmares of uncaring and corrupt adults passing along children without concern is a vicious narrative used to justify poaching off as much as the public system into private hands as possible.  “Families” For Excellent Schools’ preferred solutions actually make matters worse for the majority of students.

FES has only a passing relationship with the truth, as demonstrated by Professor Bruce Baker of Rutgers University.  Dr. Baker thoroughly destroys the group’s argument that more money per pupil in fully public schools actually harms outcomes by demonstrating that the schools with the highest per pupil spending also have the highest concentrations of special education students and students qualifying for free lunch.  Unshockingly, schools with those populations of students need more money per student in general, and achieving higher value added as measured by tests absolutely takes more money.  Dr. Baker’s research further demonstrates that the charter school sector, as currently administered, acts in a parasitic manner, siphoning off students who have lower rates of high poverty, learning disabilities, and language learning needs and skimming the resources the fully public schools need to provide appropriate services for the children who remain.  While high need districts within New York are face serious underfunding by the state’s own formula for school aid, advocates for charter schools like FES simultaneously call for more resources to be funneled from those public schools and dare to call them “failures” for not thriving.
The nerve of FES running an ad accusing the mayor of allowing African American children to languish is failing schools should be obvious – and deeply offensive – to anyone informed on the issue.  There is no doubt that too many schools struggle, but “Families” For Excellent Schools has no actual interest in improving the educational outcomes for all students in New York City.  In fact, extending genuine opportunities to all students in New York City is completely antithetical to their operating principles and would damage their brand management strategies.
Nationwide, the charter school sector has well-crafted approaches to winnow down the families who even apply to enter open lotteries – even in states where they are mandated to use random lotteries to prevent them from cherry picking students.  While Stephanie Simon’s report for Reuters noted that well known charter operators such as KIPP and Success Academy use simple application forms, that does not mean they seek to retain all of the students who make it into their schools.  Success Academy is known, in particular for practices that drive away significant portions of their students as noted here by former New York high school principal and current Executive Director of the Network for Public Education, Carol Burris who noted how Success Academy 1 in Harlem opened with 127 first graders in 2009 but only 82 remained to begin 6th grade (Interestingly, Success CEO Eva Moskowitz denied the accusation of excessive attrition in the comments section, accusing Ms. Burris of ignoring data that showed charter retention was somewhat higher overall than in nearby schools within the city.  Of course, Ms. Moskowitz was citing data for the entire charter sector while Ms. Burris was looking at the original Success Academy, and Ms. Moskowitz consistently fails to acknowledge that district schools have to replace children who leave when new students arrive at any time and that every child who leaves her schools represents a family that sought out Success Academy deliberately.)
Families that do seek out and get to attend Ms. Moskowitz’s schools quickly learn what it takes to remain there.  A parent handbook for Success Academy obtained by FOIL requests shows that Success Academy requires weekend or additional “academy” sessions for repeat “violations” of its requirements.  Excused absences cannot be had for parental illness, transportation problems, or doctor appointments.  Parental reading is a daily requirement in K-2 with no exceptions as is parental oversight of homework – which is given only in English.  While parental involvement is an important aspect for many students’ achievement, Ms. Moskowitz is essentially mandating parents who are both competent in English and who are in work and family situations stable enough to meet those expectations.  A single parent working evenings and whose child care is a relative speaking limited English is going to be unable to fulfill these requirements.
 The Success Academy network is not precisely subtle that it neither has the time to work with students who need even minor behavioral accommodations nor is it willing to keep them.  Kevin Sprowal was a Kindergarten student in Success Academy who had never been in serious trouble for behavior in three years of pre-school was suddenly disciplined constantly to the point that he felt sick at the thought of going to school.  His mother, Katherine Sprowal, received a direct message from Ms. Moskowitz that she interpreted as a veiled urging to transfer, and the school psychologist flatly said her child should be in a different school.  It is hard to take the “open lottery” for Success Academy seriously when it immediately begins to filter out five year olds who turn out to have perfectly manageable attention deficit.
The network’s methods are plainly brutal in many respects. In a special report in April of this year (that, of course, drew indignant responses from Ms. Moskowtiz), The New York Times documented the extreme high pressure placed upon the network’s very young children, including practices that are, in turn, manipulative and plainly abusive:

But at Success Academy Harlem 4, one boy’s struggles were there for all to see: On two colored charts in the hallway, where the students’ performance on weekly spelling and math quizzes was tracked, his name was at the bottom, in a red zone denoting that he was below grade level….

Success has stringent rules about behavior, down to how students are supposed to sit in the classroom: their backs straight, and their feet on the floor if they are in a chair or legs crossed if they are sitting on the floor. The rationale is that good posture and not fidgeting make it easier to pay attention. Some teachers who had orderly classrooms and a record of good student performance said, after their first year, their school leaders allowed them to bend the rules somewhat, such as not requiring students to clasp their hands as long as their hands were still….

Success did not allow a reporter to observe test preparations, but teachers and students described a regimen that can sometimes be grueling.

To prepare for the reading tests, students spend up to 90 minutes each day working on “Close Reading Mastery” exercises, consisting of passages followed by multiple-choice questions. The last two Saturdays before the exams, students are required to go to school for practice tests.

Students who do well on practice tests can win prizes, such as remote-controlled cars, arts and crafts kits, and board games. Former teachers said that they were instructed to keep the prizes displayed in the front of their classroom to keep students motivated.

Students who are judged to not be trying hard enough are assigned to “effort academy.” While they redo their work, their classmates are getting a reward — like playing dodge ball against the teachers, throwing pies in the face of the principal or running through the hallways while the students in the lower grades cheer….

At one point, her leadership resident — what the network calls assistant principals — criticized her for not responding strongly enough when a student made a mistake. The leadership resident told her that she should have taken the student’s paper and ripped it up in front of her. Students were not supposed to go to the restroom during practice tests, she said, and she heard a leader from another school praise the dedication of a child who had wet his pants rather than take a break….

At Success Academy Harlem 1, as the original school is now called, 23 percent of the 896 students were suspended for at least one day in 2012-13, the last year for which the state has data. At Public School 149, a school in the same building, 3 percent of students were suspended during that same period. Statewide, the average suspension rate is 4 percent. (A spokeswoman for Success said that the suspension rate at Success Academy Harlem 1 has since declined to 14 percent, and that several of the newer schools had rates below 10 percent.)

Students who frequently got in trouble sometimes left the network, former staff members said, because their parents got frustrated with the repeated suspensions or with being called in constantly to sit with their children at school…

“We can NOT let up on them,” she continued. “Any scholar who is not using the plan of attack will go to effort academy, have their parent called, and will miss electives. This is serious business, and there has to be misery felt for the kids who are not doing what is expected of them.”

Public shaming.  Extremely narrow behavioral norms for children as low as five.  Extra school work as punishment for not meeting standardized testing goals.  Obsessive focus on standardized test preparation. Open and blatant bribes for children who excel on test based measures.  Children who can quickly adapt to this and perform on tests as expected are welcome at Success Academy.

Which brings us back to chutzpah.  “Families” For Excellent Schools will rally next week with Ms. Moskowitz’s students front and center providing the optics of minority children in need of great schools and opportunities.  They will claim to be there for the “half a million” children “trapped in failing schools” (last year, they claimed it was 143,000) and who need “new schools, now” – by which they mean charter schools in the Eva Moskowitz model.

But those charter schools – and Ms. Moskowitz’s schools in particular – do not want all of those children they will claim to speak for next week.  They want the children whose parents have stable enough work lives and English proficient enough that they can meet all of the out of school expectations without exception.  They want children who do not require any accommodations that would alter their extraordinarily rigid approach to early childhood behavior.  They want children who can immediately adapt at the age of five to excessive conformity, who can handle public shaming and extraordinary pressure, and who will emerge from that environment with high standardized scores.  Everyone else can go pound sand.  More specifically, everyone else can go back to their district schools which now have even higher concentrations of children in high poverty, with serious special learning needs, and with English language learning needs but which have fewer monetary and physical resources with which to help those children.  Far from speaking for half a million kids in need of great schools, “Families” For Excellent Schools will use 1000s of children as props to denigrate the work and efforts of 100s of schools and tens of 1000s of teachers and hundreds of 1000s of other children simply because of their test scores.  Worse, they will call for even more resources to be hoovered out of those schools – even though the “no excuses” charter sector in New York is 100% dependent upon having zoned schools that will take the children they refuse to accommodate.

“Families” For Excellent Schools does not give a damn about most of the children in New York.  Don’t let them get away with claiming they do.

Ahmed Mohamed’s Clock And Teachers Checking Themselves

Unless you were on an Internet and media blackout this week, you heard about Ahmed Mohamed, the 14 year old high school student in Irving, Texas whose homemade clock got him detained by police and suspended from school for making a “hoax bomb.”  Young Mr. Mohamed is an avid tinkerer and builder who is frequently photographed in a NASA t-shirt and whose fondest wish is apparently to attend the Massachusetts Institute of Technology, and his clock was one of his many home projects which he wished to share with his engineering teacher. Unfortunately, another of Mr. Mohamed’s teachers was suspicious of the clock, failing to understand that wires, circuit boards, and LED displays do not explode, called in administrators who called in police, and the result was Mr. Mohamed finding himself detained in handcuffs and then suspended from school:

Unfortunately, Irving Mayor Beth Van Duyne openly defended both the school and the police, and actually voiced  concern that the incident could deter police from investigating potential threats instead of showing the least concern that bright and inquisitive student inventors are already deterred from letting anyone know they love science and inventing.  Then again, Mayor Van Duyne is known for campaigning against imaginary threats of Sharia law, so we should not expect much.

The chief of police in Irving, Larry Boyd, also defended his officers, even while admitting that they determined quickly that the clock was not a bomb.  Given that information, Mr. Mohamed’s detention and suspension are even more outrageous, and the insistence of authorities that those actions were justified because they believed the clock was a “hoax bomb” looks like a pathetically thin cover for a series of prejudiced assumptions.  Mr. Mohamed never said that his clock was a bomb and demonstrated no interest in trying to trick people into thinking it was a bomb.  The school obviously concluded it was not a bomb very quickly since they took no actions to get students to safety.  To believe the “logic” of school officials and the Irving police, you have to believe that the word “hoax” requires only the ignorant assumptions of others rather than any intention to deceive on the part of the accused.

From one perspective, Mr. Mohamed’s misfortune has yielded some positive results. As his story circulated, he gained positive feedback from national leaders and figures in technology and innovations.  President Obama’s twitter feed issued an invitation to take the clock to the White House:

And, perhaps the icing on the cake, an astrophysics professor from MIT invited the young inventor to visit the campus, and said he was the kind of student the institution likes.

So – there’s a bit of lemonade from this.

Which is good because it is disgraceful that it came to a point where any of us have heard of Ahmed Mohamed.  Instead of being given the kudos and encouragement he deserved from those who knew him and were entrusted with his well being, he was humiliated and punished for nothing more than being a curious and inventive student.  Assume for a moment, that his English teacher’s confusion and suspicion of the clock was justified.  I don’t actually want to because it betrays a really staggering amount of STEM illiteracy to look at an LED display, a circuit board, some wiring, and a plug for a wall outlet…

…and fail to conclude that it is safe.  But fine, assume the English teacher was not reacting out of absurd and prejudiced impulses.  The entire issue could have been settled in less than a minute with the following conversation:

English Teacher: “Hi, Ahmed.  What’s that thing that beeped?”

Ahmed: “Oh, it’s a clock I made at home and brought to show my engineering teacher.”

English Teacher: “You made a clock at home? Yourself?”

Ahmed: “Uh-huh.”

English Teacher: “That’s pretty cool! Can you show us how it works?  Then maybe make sure it doesn’t interrupt class again, please?”

There, done. “Problem” solved. No national story, here.  Just a kid getting an appropriate level of recognition for doing something cool.   Instead, the sequence of events went like this: His English teacher KEPT the clock (despite claiming it looked like a bomb), Mr. Mohamed was pulled out of a later period by the principal and a police officer, he was queried about trying to make a bomb whereupon he repeated that he had made a clock, taken from school to the police station, handcuffed, fingerprinted, questioned without his parents where he said his last name was brought up repeatedly, and accused of bringing a “hoax bomb” to school with three teachers listed as complainants. The police claimed that Mr. Mohamed was being “passive aggressive” with them, and claimed “We attempted to question the juvenile about what it was and he would simply only say it was a clock. He didn’t offer any explanation as to what it was for, why he created this device, why he brought it to school.”

Here’s a little explanation for the officers: It’s a clock. It tells time.  If Mr. Mohamed made a clock and would “only say it was a clock” it is probably because it. is. a. clock.

Look, running a school is a difficult and uncertain business, constantly fraught with circumstances you never expected.  One of my favorite stories illustrating how hard it is to be school principal is from some years back when an elementary school in Montana had to make a new rule for show and tell after a student’s mother brought a dead bat in a shoe box — and 90 kids had to get rabies shots.  Imagine the poor school principal having to revamp the school rules in the wake of that.  The school probably had anticipated various things not appropriate for show and tell, but I am betting nobody had ever thought of a “please do not bring in diseased infested carrion you found in your barn”.  That’s the sort of thing that makes running a school and a classroom so unusual – you can think of every possible circumstance imaginable, but 25 kids and their parents and guardians can almost always confound your imagination.

So schools are charged with keeping everyone safe within their walls, and we live in an age where schools have tried to respond to real and imagined threats with especially harsh rules that have ugly consequences.  But what happened to Ahmed Mohamed had nothing to do with keeping the school safe. His teacher suggested the clock looked like a bomb despite what he told her, but she kept it instead of immediately evacuating the classroom. Mr. Mohamed was questioned by the principal and the police that the administration had summoned without asking for a bomb disposal specialist.  Mr. Mohamed repeatedly said to his teacher, to the administration, and to the police that he had made a clock, and yet he was finally accused of making a “hoax bomb” despite trying to to tell everyone and anyone who would listen that it was a clock – which it is – making the “hoax” accusation laughable.

At every stage of this disaster, the adults who had authority over Ahmed Mohamed and who had professional and ethical obligations to care for his rights and well being could have stepped back and stopped, but they did not.

It is impossible to escape looking at the very real likelihood that he was suspected of mischief because of prejudice against his name and his religion. None of the adults gave him the benefit of the doubt, and even though they had to have quickly concluded that the clock was entirely safe, they still could not entertain the notion that he had made it and brought it to school for the understandable reason that he wanted to show off what he could do for a teacher he hoped to impress.  Instead of backing off, they doubled down on their initial errors, compounding them with new ones.  Instead of acting to keep their students safe, they invented an entirely bogus reason to justify their initial prejudice, and violated the rights and trust of a young man who ought to have impressed them.

Teachers and administrators are not perfect people.  We have prejudices and irrational impulses, and it is impossible to banish all of them from our actions every single day.  But it is absolutely vital to pause and check yourself.  Ahmed Mohamed’s English teacher could have settled this with a simple and quick conversation.  If that teacher insisted on clearing that impression with an administrator, that person should have quickly recognized the innocuous nature of the clock and returned it.  At worst, the principal could have had a simple conversation with the young man and logically understood that when someone keeps calling a clock a clock, it is ridiculous to assume he intends to trick people into thinking it is a bomb.  Ideally, the educators involved should have been embarrassed by their initial assumptions and fears and what spawned them, but at a minimum, they should have recognized their responsibility to Ahmed Mohamed as soon as it was obvious that he had a clock.

Unchecked prejudices lead to unfounded fears, and in this case, they led to far worse.  Every teacher has to be aware of her or his personal flaws and prejudices, and has to constantly check her or his actions against them to strive for fair and ethical treatment of every student.  Nobody did that for Ahmed Mohamed.

Announcing the iSchool, or Something

Apple CEO Steve Jobs was not known as a philanthropist during his lifetime, but his wife, Laurene Powell Jobs, had a significant track record in philanthropic endeavors by the time of his death in 2011.  Educated with a Stanford MBA and with experience as a trader in Goldman Sachs, Ms. Powell Jobs has an extensive record in philanthropic activities since at least 1997, and education appears to be a specific interest. Beginning with a mentoring program for first time minority college attendees, she now sits on the boards of a number of familiar organizations such as Teach for America, New Schools Venture Fund, and Stand for Children.  According to her “Inside Philanthropy” profile, Ms. Powell Jobs is interested in education reforms that are “results driven” which is education philanthropy speak for “raises test scores”.  Hardly surprising, since her board memberships are groups that contribute to the deprofessionalization of teaching (TFA), raise capital for charter school ventures and advocate legislatures to allow charter school teacher training “academies” (New Schools Venture Fund), and which consistently attack teachers’ workplace protections and advocate for increasing the role of test scores in education and teacher evaluation (Stand For Children).

It should not, therefore, be a great surprise when The New York Times announced that she would donate $50 million towards a new education venture “to rethink high school.”  The effort is called “XQ: The Super School Project” and Ms. Powell Jobs said in an interview, “The system was created for the work force we needed 100 years ago. Things are not working the way we want it to be working. We’ve seen a lot of incremental changes over the last several years, but we’re saying, ‘Start from scratch.’ ”  This “from scratch” take on the American High School essentially looks like a grant program from the pot of $50 million that will eventually be distributed to 5 to 10 grantees sometime in the next year.

The project website tells you precious little about the values of the project itself, which might be a good sign if they are serious about soliciting widely for actual, community based, ideas for school experimentation instead of just opening the doors for a bunch of ready made “disruptors” already at work tearing down public education.  The composition of her core team as reported in The Times is not encouraging. There is a consultant named Keith Yamashita who has worked apparently mainly in technology and start ups.  Russlynn H. Ali is the former undersecretary of education for civil rights under Secretary Arne Duncan and has been working with Ms. Powell Jobs’ Emerson Collective.  More troubling is the presence of former senior adviser to New York City Schools Chancellor Joel Klein, Michelle Cahill.

Education blogger, author, and Louisiana teacher Mercedes Schneider once dubbed Chancellor Klein as “The Man From Whom Nothing Good Comes,” and I’d daresay he earned the title.  Certainly, the Klein Chancellor’s office unleashed a fair deal of havoc on Newark when Mark Zuckerberg’s 100 million dollar grant to remake the city’s schools was announced.  Former Klein insider, Chris Cerf, created a consulting firm that hoovered up a fair amount of the available cash, and Cerf himself moved in 2010 to the New Jersey State Commissioner’s office, meaning he was now overseeing the district. Klein’s NYC department of education also provided Newark with Superintendent Cami Anderson, whose disastrous tenure is chronicled by retired Star Ledger journalist Bob Braun.  Cerf and Anderson are most directly responsible for turning the Zuckerberg donation into the “One Newark” system, and Mark Webber helps fill in the holes in the most recent accounts of how that has turned out – especially in regards to Brick City’s charter sector.  Short version: Joel Klein’s office provided a significant portion of the reform “talent” that spent lavishly on consultants and threw the city’s schools into an incompetently and callously managed mess that has benefited the biggest charter operators most of all.

So let’s just say that the presence of another member of Joel Klein’s inner circle in a grant program to “rethink” schools requires serious skepticism.  At least the amount of money being spent is only half of a Zuckerberg, and it will be spread around rather than dropped into a single school district with the intention of blowing the entire kit and caboodle up.

However, I’d like the challenge two premises of the entire endeavor.  The first premise is that we still have the high school we created “for the workforce 100 years ago.”  In some respects this is actually true.  The school model based upon a set of discrete subjects taught in Carnegie units with students moving from subject to subject during the day was an organizational choice of the early 20th century.  Similarly, the comprehensive high school and extra curricular activities and sports with which we are familiar were choices incubated in the Progressive Era — none of these came down with Moses on Mt. Sinai.  However, to suggest that the school structure you recognize as school is somehow rooted in place, unchanging and incapable of meeting more modern needs, is not supported by evidence.

For example, that same school structure that Ms. Powell Jobs says was created for the workforce “100 years ago” has also graduated the workforces of the 1950s and 1960s as well as the workforces of the 1980s and 1990s – all economic periods vastly different than 1915. If one were to cite threats to the workforce in 2015, one would have to look at falling union membership, declines in wages for recent college graduates, a young work force burdened by mounting debt, corporate hoarding, unmet infrastructure needs, and taxation policies that have abetted income inequality before looking at how most ninth graders will study English for 50 minutes before moving on the their Algebra class.  Schools contribute to the shaping of the workforce, but they do not create the economic demands for workers that necessitate that workforce on their own.  And the reality is that the American economy has grown leaps and bounds with this same school system.  In fact, from 1929 to 2015 “real” Gross Domestic Product in 2009 dollars (opens in Excel) grew from 1056.6 billion dollars to 16,324.3 billion dollars — all with that school system lamented as being designed for the workforce of 1915.  Not bad.

Further, schools have changed in the past century, in meaningful and significant ways.  The landmark report, 120 Years of American Education: A Statistical Portrait from the Department of Education’s Center for Education Statistics details a school system that has made vast developments in both the reach and equity of the system over time.  From the general formation of the comprehensive high school, the institution has continued to expand both the population it includes and the services it provides within its walls, reflecting major changes in how society views the reach of the political franchise.  Consider these two charts:

Similar progress and change can be seen in statistics relating to the educational attainment of women and to the number of children with disabilities being accommodated within public schools.  And these statistics on increased participation, completion, and services provided do not account for changes in subject matter content over time as well. The fact is that there are many things about our high schools that have been significantly dynamic over the past 100 years.

The second premise that needs to be challenged is that the schools we need should represent a “start from scratch” approach.  There are powerful ideas for change that many districts could implement with very little difficulty.  In their historical study Tinkering Toward Utopia: a Century of Public School Reform, scholars David Tyack and Larry Cuban demonstrated that many “big ideas” for school reform tended to be changed by school as much as they changed school, but that certain little ideas can have substantial impact.  For example, a simple offset of classroom walls creating niches changed the way teachers used their space substantially.  So while the XQ little marquee questions “What if we take our desks outside?” “What if learning is a game?” “What if we knock down these walls?” – I am left wondering “what more will you get with $50 million than 5-10 boutique programs that may not be scalable while you could be trying to leverage more meaningful changes within the existing system that already serves almost 15 million high school students?”

The fact is that we have some pretty good ideas already about what would leverage substantial change in our schools. Some of these ideas are larger than others and would require significantly more political capital to achieve.  However, if Ms. Powell Jobs is actually serious about our schools being “the great equalizers they were meant to be,” she should shake off the “disruptive start up” mentality of the XQ project and put her talents to work on some of the following ideas that never seem to make it into education reform’s portfolio of strategies:

  • Integration: It matters, for both the majority and minority populations that are integrated, and we have historic evidence to demonstrate this.  The decrease in achievement gaps between white and black students as measured by the National Assessment of Education Progress closed rapidly and for a sustained period of time in the 1970s and early1980s before the cumulative impacts of white flight and abandonment of fair housing and integration policies stalled progress.  Since then, racial and economic segregation have increased vastly, to the great detriment of our students and their schools which saw an initial, large, burst of the gap closing after NCLB only to see it stall again.  While the issue of the achievement gap is extremely multifaceted and overlaps with declines and rises in child poverty, integration of our communities and schools remains an important and currently unutilized tool in school improvement.
  • Fair Funding: Advocates of current reforms like to scoff at school funding, but the reality is we maintain a perversely unfair and inadequate system of school finance that all but guarantees wealthy communities can fund the schools that they want while the rest of the system struggles to get sufficient state and federal aid to plug the holes in their budgets.  Resources and policies the reduce inequality cost money, and the reluctance to fund those resources and policies is one of the greatest stumbling blocks to educational improvement.
  • Class Size Reductions: Among the policies that can cost more money that politicians are reluctant to spend is class size reduction. It works.  It works well.  It works even better for poor and minority students. Increasing class sizes causes real and long term harm.
  • Teacher Retention and Development: This will come as a surprise to the organizations on whose boards Ms. Powell Jobs sits, but experienced teachers are better than newcomers.  The exuberance of youth is fantastic and necessary in the ongoing work of school, but it is best paired with experienced teachers who know what they are doing and who are willing to mentor their younger colleagues. If we want to improve schools, we should be looking at improving teacher retention, starting with a hard look at working conditions.
  • Reverse High Stakes Testing’s Detrimental Impacts: We’ve increased the amount of testing.  We’ve increased the stakes on testing.  To the surprise of nobody who understands policy incentives that means we’ve increased the amount of time spent teaching to the test and to test preparation, to the detriment of a rich curriculum and especially to the detriment of students attending majority minority schools threatened with closures and other punitive measures due to test scores.  The narrowing of the curriculum also has a detrimental impact on the very skills so-called education reformers claim our students need the most in the 21st century.  If Ms. Powell-Jobs really wants to improve high school, she could do a lot worse than to imitate her late husband’s business practices and to try very hard to kill off something that Bill Gates has worked to promote: high stakes testing in teacher evaluation.

$50 million is going to buy the XQ project a handful of high schools that may or may not be innovative and which may or may not be able to be scaled.  Or it could begin the process of lobbying policy makers to endorse what we actually knows works in education.  It would certainly be a lot better to see on the side of a bus kiosk.

NY Commissioner Elia: The Time for Charm is Over; Let’s Start the Empty Threats

When MaryEllen Elia took over as Commissioner of Education in New York, she began by traveling the state to speak with various constituents about the direction of education in the Empire State.  This was no doubt in response to former Commissioner Dr. John King Jr.’s decided inability to listen to and to engage with stakeholders in public education, and Commissioner Elia should be granted kudos for being willing to step outside of her office in the current climate.  According to Principal Carol Burris, who attended the meeting between Commissioner Elia and New York State Allies for Public Education, MaryEllen Elia was cordial and generous with her time.  However, as was obvious from her resume in Florida, it is plain that New York’s new Commissioner is a true believe in the Holy Trinity of education reform: Common Core standards, high stakes standardized testing, and punishing schools and teachers whose students do not measure up on those examinations.  It is clear that the “listening tour” was more about changing the style than the substance of the New York State Education Department.  Ms. Burris, who recently took an early retirement to dedicate herself to defending public education, noted:

Back in the 1960s, Marshall McLuhan coined the phrase, “the medium is the message.” McLuhan argued that the medium that delivers any message is of equal, if not greater, importance than its content.   Clearly the Board of Regents believes that by pivoting from the stiff and professorial King to the attentive and engaging Elia, parents and teachers will come to their senses and begin to like the Common Core and its tests.

So while I will give Commissioner Elia some marks for actually speaking with stakeholders and for accepting opportunities to speak with opponents of her favorite education reforms, there is no reason to think she will change anything of substance.

And now the charm offensive is over.  It is time to start in with the threats.

In a conference call with reporters, Commissioner Elia reported that the NYSED is discussing with the US Department of Education potential consequences for schools with high numbers of students who refuse the state standardized examinations.  The Politico New York story was followed by a story in The New York Times which states:

Officials at the federal Education Department have awhile to decide what to do. The state will not officially report its test participation rate to the federal government until mid-December, and the number will not be considered final until sometime after that, the State Education Department said on Thursday.

On Wednesday, the federal Education Department’s spokeswoman, Dorie Nolt, said the agency was looking to the leadership of New York’s Education Department “to take the appropriate steps on behalf of all kids in the state.”

New York led the country in students refusing to take the state standardized exams with roughly 20% of students between grades 3 and 8 and in 11th grade refusing.  These numbers are not, however, evenly distributed with large numbers of the 200,000 students not sitting for the exams in Nassau and Suffolk counties on Long Island. However, as reported in the Times there were also high needs districts dependent upon Title 1 funds for students in poverty who had large opt out numbers.  Commissioner Elia told the Times that federal officials had asked her what “plan” she has for “dealing” with districts that have high numbers of opt outs.

So will this be how Opt Out ends?  With the federal DOE and NYSED joining together to punish districts who do not meet federal testing numbers until everybody agrees to play along?

Outlook not so good

In order to understand whether these threats have any teeth, one has to understand why they would be made in the first place.  There are several interconnected issues.

95% of all students in all subgroups must be tested annually.  Under the 2001 re-authorization of the Elementary and Secondary Education Act known as No Child Left Behind, every school in the country must test every student in mathematics and English every year between grades 3 and 8 and once in high school.  There are no exceptions allowed to this.  Based upon this requirement, there are a number of schools and districts where test refusal has dropped the percentage of tested students well below this threshold.  However –

NCLB testing requirements were meant for schools, districts, and states, not for parents and students.  When Congress passed NCLB on a bipartisan vote, their intention could not have been clearer.  They were concerned about historic evidence of communities and states quietly shunting certain populations of students outside of accountability measures and subsequently ignoring their educational needs.  This same argument has featured prominently in recent debates over renewal of NCLB and the fate of annual testing.  Regardless of what anyone thinks about the merits of annual testing of all students versus gradespan testing of samples of students, the intent of the legislation was to make certain that schools and states could not duck out of accountability for all of the students enrolled in public school.

In fact, the federal DOE made that same point to New York when it rejected some provisions of the state’s renewal application for waivers from various NCLB provisions.  The state requested that English language learners who have been in the country for less than two years be exempted from the state English examination, but the Federal DOE cited that the state has only a limited exemption capability and then referenced that the state is required to create a “single, statewide, accountability system” and that this “requirement is necessary to ensure that schools are held accountable for the academic achievement of all students…”  The state is extremely limited in its ability to exempt students from the examinations, and the schools are supposed to be accountable for their students’ learning.  To that end, New York State has contracted and administered a system of annual statewide testing, albeit a controversial one, and schools administer those tests.

However, nothing in the statutes can make a school force students to take a specific standardized exam, and there is no mechanism for punishing a student for not participating in an exam that makes up none of that student’s grade.  Schools across the state have implored parents to not opt their children out, they have put out contradictory information about what consequences might befall a school that falls below 95% of children tested, and they administered the exams to every child whose parents did not refuse them.  However, there is no statutory authority that allows a school or school district to compel taking the exam, and it is contrary to the intent of NCLB to hold them accountable for actions beyond their control.

Consider another federal education law: the Individuals with Disabilities in Education Act.  Under that law, schools and school districts must provide all students with a “free and appropriate public education” in the “least restrictive environment,” and schools are required to be proactive about students who are potentially disabled, conducting “child find” before the student falls behind academically.  School districts are sued routinely for failing to live up the provisions of IDEA, but if parents decline to participate in the evaluation process for special education services, the school is not held accountable for failing to evaluate and has only limited means to proceed without parents. In the case of IDEA, this is made explicit in the regulations.

NCLB does not address parental consent for or against annual standardized testing, but that is because the legislation is meant to hold schools, districts, and states accountable – not parents.  So long as all districts and schools are doing their best to ensure that as many students are tested as is possible, they are clearly fulfilling their obligations under the law.

About those waivers from the Federal DOE: While the Federal DOE did not grant all of New York’s waiver requests, the state is operating under a broad waiver from many of the more punishing provisions of NCLB.  This waiver specifically allows the state to identify schools that fail to make Annual Yearly Progress on standardized exams as Priority and Focus Schools instead of as schools for restructuring. 20% of Title I funds under the waiver no longer need to be spent on supplemental services and/or transportation for school choice options, and are replaced with funding for specific state programs and increased parental involvement.

Test refusal in large numbers in districts receiving Title I funds will complicate the state’s ability to identify reward schools, priority schools, and focus schools, but that is a matter between Albany and Washington, D.C. rather than between either capitol and individual schools.  Given that school districts have gone as far as to use the arguably abusive “sit and stare” policy to try to coerce test participation, there is no argument that either Albany nor Washington can make that holds entire schools responsible for the actions of a portion, plurality, or majority of their parents, so what argument is there to withdraw Title I money from specific schools when the entire state operates under waivers?

In a decade and a half has ANY school ever lost Title I funds for missing testing numbers? In a word, no.  Fairtest is a nonprofit that monitors testing across the country and advocates for changes to our standardized testing environment, and they are unaware of a single school, anywhere, that has ever lost Title I funds for missing the 95% testing requirement.  The scale of the Opt Out movement in New York may be a new phenomenon, but that does not suddenly grant Washington and Albany the power to do something they’ve never done before.

So what if Commissioner Elia and the US DOE find some way to claim statutory authority?  What then?  What then would be a political firestorm of epic proportions.  Apart from obvious lawsuits, imagine the situation. NYSED or the federal government threaten sanctions for failing to test 95% of students, but their only real option is to withhold Title I funds which are allocated to schools with significant percentages of students in poverty.  So that would leave a community like, say, Rockville Center on Long Island, which had a 62% opt out rate this Spring, essentially untouched. Why?  Rockville Center’s population’s is much wealthier than the state average, and its single middle school only has 10% of students qualifying for free and reduced price lunch.

Compare that to the Earth School in Manhattan.  According to this statement from the Movement of Rank and File Educators, 100 students at the ethnically diverse elementary school refused this year’s tests.  Earth School is 44% African American and Hispanic and 43% of its students qualify for free or reduced price lunch.  Or how about Dolgeville Middle School upstate where 64% of its students qualify for free or reduced price lunch and whose district had an 89% opt out rate?

Does anyone actually think that Albany or Washington could withstand the fury they would unleash by withholding federal money meant to aid schools with high percentages of student in poverty – inflicting great harm on students who are among the urban and rural poor – while leaving affluent suburban schools mostly unscathed?  The situation would be patently discriminatory on its face, and it could never stand either in the court of public opinion or in state and federal court.

NY Commissioner Elia and Secretary of Education Arne Duncan may be threatening to pull out a gun against Opt Out, but the first rule is never pull a gun you are not prepared to fire.  In this case, it would help to make sure the gun is loaded and is not, in fact, a banana.

Teachers: Chris Christie Wants to Punch You “In The Face”

New Jersey Governor Chris Christie is fond of saying that his preferred method of dealing with bullies is to “punch them in the face”.  It is the sort of “tough guy” talk that has served him up to this point of his political career and which used to earn him legions of fans who delighted in his outbursts of temper aimed at critics.  On Sunday of this week, he appeared on Jake Tapper’s “State of the Union” show on CNN, and when the host asked him “At the national level, who deserves a punch in the face?” he did not hesitate for a moment before saying “The national teachers’ union.”

(Mr. Tapper followed up this statement by a really hard hitting question asking Governor Christie why he was now saying his favorite New Jersey Musician is Jon Bon Jovi over Bruce Springsteen.)

So there you are — the very first people or entity that Governor Chris Christie thinks of when he contemplates a national level “punch in the face” are teachers and the union made up of millions of them.  Not the near historically ineffective legislative branch.  Not K Street’s infamous lobbying industry where former law makers go to get rich.  Not even the national press, attacks against whom have been red meat for conservative voters for decades.  The “national teachers’ union” which Chris Christie calls “the single most destructive force in public education in America.”

Observers of Governor Christie are hardly surprised by this as the governor, in his words, has been “saying this since 2009” when he sought the Governor’s office in New Jersey, and he has not let up his assault on the Garden State’s teachers since then.  In a New Hampshire Town Hall in June, Governor Christie gave a laugh line where he said that our national education system was a threat to the country equal to ISIS, and he went on to insult the work of the teachers he just compared to a fanatical terrorist organization:

“It’s the same as it was in the 1800s, for God’s sake. It’s a row of desks. Facing forward to a blackboard or a whiteboard. A person standing in the front of the room talking to the people in the desks. And they do so from roughly 8:30 to roughly 2:30 or 3 o’clock, and they’re off four months a year…We don’t have it (a longer school year) because the teachers’ union likes to be off 4 to 5 months a year.  They like to get a full time salary for a part time job.”

Governor Christie may have tried to give himself wiggle room by saying “teachers union,” but there is no doubt that he meant “teachers” – who make up the union membership, elect the union leaders, and about whose work he offered the most foul and disrespectful caricature this side of Bart Simpson’s relationship with Mrs. Krabappel. Chris Christie has zero respect for teachers whose work he thinks consists of talking at students for 6 hours a day and lazing around for a quarter of the year with nothing to do.

New Jersey teacher and researcher Mark Weber offers this definitive catalog of how often Governor Christie has used his office to denigrate teachers.  Amidst the outrageous accusations, such as saying teachers used students as “drug mules” for a social studies assignment, an interesting pattern stands out that also explains why the governor feels the need so often to punch people who offer public criticism.  Namely, famous “tough guy” who is always “telling it like it is” can dish out the punches, but he certainly cannot take them.  Consider Governor Christie’s assertion that the New Jersey Education Association said that he “hates children and loves millionaires.”  This was obviously in reference to a billboard campaign urging people to “Tell Governor Christie to protect our schools; not millionaires.”  Direct, but hardly an accusation that he hates children.  Further consider Weber’s documentation of Governor Christie claiming that NJEA officials prayed for his death when the “prayer” in question was a moderately tasteless joke.

More recently, Governor Christie has demanded that union leaders and rank and file “get realistic” over New Jersey’s ability to keep its pension system afloat, and accused those calling for him to abide by the 2011 pension reform plan that he himself championed –  and then abjectly refused to fund – of “gluttony.”  This is an astonishing effort to portray himself as the victim in the pension fight when he won the legislative fix he sought, refused to make the promised payments into the pension system, simultaneously gave management of huge portions of it to hedge funds that increased the state’s management payments to over $1.6 million a day, and is now crying poverty when unions and law makers demand that he keep his promises.

At the heart of Chris Christie’s most bellicose moments — with teachers and with others — is this same pattern: outrage at being challenged, portrayal of himself as the victim of others’ attacks, and using anger and energy to hide the fact that he has no real answer for the challenge presented. Even while asserting that as President the first people to get a “punch in the face” will be unionized teachers, he claims that he has “got the scars to show” that the unions are “the single most destructive force in public education.”

Any scars Governor Christie has are, in fact, self inflicted.  Pushing through and touting a pension reform plan that the NJEA accepted without threats of labor actions but then saw the Governor refuse to fund? Self inflicted.  Repeated encounters with professional teachers that show just how much Governor Christie enjoys punching down on those far less powerful than he is? Self inflicted. Pandering to primary voters at the expense of every school in the state that has been working overtime to keep up with the pace of reform demands in Trenton? Self inflicted.

Who has the real scars in New Jersey?  Teachers trying to work in schools that remain underfunded, and who are subject to performance evaluations based on ill thought out and invalid methods. Students whose educations are being distorted by a confusing and punishing system of high stakes evaluations that incentivize teachers and school districts to teach to the test. Families, and indeed entire cities, subjected to poorly and callously planned school “choice” plans that separate siblings and unleash chaos on schools without sufficient benefits.

That Governor Christie continues to portray himself as a “victim” in a drama where he is the main antagonist is no longer surprising.  What is hopeful is how few people seem to be buying it either in New Jersey or nationally.
